By placing an order, you are making an offer to purchase. Owen reserves the right to accept or reject any order at its discretion. An order is not considered accepted until Owen confirms its acceptance. Payment must be received and processed before the order is accepted.

Please review your order carefully before confirming it, as we may not be able to accommodate cancellation requests once the order has been accepted. If we do not accept, modify, or cancel an order, we will attempt to notify you using the email address, billing address, or telephone number provided.

Purchases are eligible for returns or exchanges only in accordance with our Returns & Exchanges Policy.

You represent that your purchases are for personal or household use and not for commercial resale or export.

Section 4 - Prices, VAT and Payment Methods

All prices displayed in the store include applicable VAT in accordance with Spanish consumer protection regulations. Shipping costs are displayed separately before you confirm your purchase.

Prices, discounts, and promotions are subject to change without prior notice. The price applied will be the price in effect at the time the order is placed, as reflected in the order confirmation email.

Prices in the online store may differ from those offered through other channels or by third parties. Specific promotions are governed by their own terms and, in the event of a conflict, those promotional terms will prevail over these Terms.

Accepted payment methods include credit/debit card, PayPal, and Bizum. By completing your purchase, you represent that the payment information provided is accurate and complete and that you are authorized to use the selected payment method.

Section 5 - Shipping and Delivery

Delivery times provided are estimates and do not constitute a guarantee. Owen is not responsible for delays caused by logistics providers, customs authorities, or circumstances beyond our control. Once the order has been handed over to the carrier, the risk and responsibility for the product pass to the buyer.

Section 6 - Legal Product Guarantee

In accordance with Spanish Royal Legislative Decree 1/2007 and applicable European Union regulations, all Owen products are covered by a 3-year legal guarantee against manufacturing defects or lack of conformity, starting from the date of delivery.

If a product has a defect covered by this legal guarantee, you are entitled, as applicable, to repair, replacement, a price reduction, or termination of the contract. To exercise this right, please contact us at info@theowenstore.com as soon as possible, providing your order number and a description of the issue.

This legal guarantee does not cover damage caused by improper use, accidents, or normal wear and tear.

Section 7 - Right of Withdrawal

In accordance with European Union consumer protection regulations, you have the right to withdraw from the purchase contract within 14 calendar days of receiving your order, without having to provide a reason.

Owen voluntarily extends this period to 30 days as part of our commitment to customer satisfaction.

Section 8 - Intellectual Property

The Owen Services, including trademarks, text, images, designs, videos, and other content, are owned by Owen or its licensors and are protected by Spanish and international intellectual and industrial property laws.

The Owen name, logo, product names, and slogans are trademarks of Owen or its licensors. They may not be used without express authorization. The Shopify name and logo are registered trademarks of Shopify Inc.

You may have access to tools provided by third parties as part of the Services, over which Owen has no control or responsibility. Such tools are provided "as is", and your use of them is at your own risk and discretion.

Owen uses Shopify as the technology platform for operating the store. However, all purchases are made directly from Owen.

By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of transactions between you and Owen, including any damage or loss arising from products purchased. You expressly release Shopify and its affiliates from any claims related to your purchases.

You will remain responsible for any outstanding amounts due up to the date of termination.

The sections relating to Intellectual Property, Limitation of Liability, Indemnification, and Governing Law will remain in effect after termination.

The Services and products are provided "as is" and "as available", without express or implied warranties beyond those required under applicable Spanish law.

Owen does not guarantee that the Services will operate uninterrupted, securely, or free from errors.

This disclaimer does not affect any statutory consumer rights recognized under Spanish and European Union law.

Section 20 - Limitation of Liability

To the fullest extent permitted by Spanish law, Owen will not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Services or products purchased, including loss of profits, data, or revenue.

This limitation does not apply to consumers' statutory legal guarantee rights recognized under Spanish Royal Legislative Decree 1/2007.

Section 25 - Governing Law and Jurisdiction

These Terms and Conditions are governed by Spanish law.

For the resolution of any dispute arising from these Terms, both parties submit to the jurisdiction of the Courts and Tribunals of Valencia, Spain, without prejudice to any rights granted to consumers under consumer protection laws applicable in their place of residence.

The store currently operates in Spain. If sales are made to other European Union countries in the future, specific conditions may apply in accordance with the laws of the destination country and will be communicated to the customer during the purchasing process.
